Phantoml0rd Sues Twitch over Mishandling of 2016 Ban
Popular Twitch streamer Phantoml0rd filed a lawsuit against Twitch on February 14. The lawsuit was filed in the city of San Francisco with the Superior Court of California. Twitch now has 30 days to respond to the case.
Back in July 2016, James “Phantoml0rd” Varga was indefinitely banned from Twitch and his entire channel was deleted. Now, almost two years later, Varga is suing the streaming giant over how they handled the matter.

Varga claims that Twitch mishandled the deletion of his channel. In the lawsuit, he states that when his channel was first deleted, Twitch failed to give him proper notice and violated their policy by not providing him with a “written notice of any purported violations of the contract.”
He claims that Twitch sent him an email telling him that he’d been given an “indefinite ban,” but at the time they did not provide an explanation. According to Varga, it was not until January 7, 2017, five months later, that Twitch provided him with an official explanation.
The reason for Varga’s ban was that he had been promoting CSGOShuffle, a CS:GO skin gambling website, on his channel. Not only that, but it was later alleged that Varga was also the owner of the website. While it was never officially confirmed and Varga has never confessed to being the website’s owner, Youtuber Richard Lewis posted a video providing some strong evidence suggesting that Varga did in fact own the website, and that Varga had a habit of winning on this site.

CSGOShuffle was taken down two years ago. Valve, the developer of the Counter Strike games, had been cracking down on many of these CS:GO gambling websites for “violating their Terms and Services” and they even filed a lawsuit against one of these websites, CSGO Lotto.
As punishment, Twitch deleted Varga’s entire channel on the grounds that promoting an unapproved gambling website on his channel was a violation of their Terms and Services.
However, the documents of Varga’s lawsuit claim that Twitch’s allegations of his misconduct are false, and that the evidence Twitch had used to justify his ban were not violating any of Twitch’s official rules. Not only that, but Varga is suing Twitch for financial damages and damages to his reputation caused by the ban.
So far, there are no updates in the case since the official filing, but we’ll update this article as the story progresses.
