YouTube In Trouble For Collecting Data On Children

This week, Mark Zuckerberg testified before congress regarding Facebook’s potentially illegal data collection practices, but they’re not the only ones being scrutinized for how they handle data. A complaint has been filed jointly by almost two dozen advocacy groups accusing YouTube of gathering data on children, without receiving proper consent.

Google directly states in their privacy policy that they can and will collect data from their users. They do this in order to promote ads that are tailored specifically to the individual. However, collecting data from minors is not part of that policy. In fact, the practice is in direct violation of the Child Online Privacy Protection Act (COPPA), which places restrictions on companies and requires them to inform and get consent from a minor’s guardian in order to collect data.

YouTube Collecting Data On Children

YouTube may or may not currently be in decline, but it’s still one of the most popular video sharing sites on the internet. Over the past decade, the site has changed for better and for worse, but kids watching inappropriate videos is as old as the internet itself. Even after the creation of the (supposedly) child friendly YouTube Kids, children unsurprisingly have continued to watch videos on the original YouTube.

The root problem is that age gates, like YouTube’s requirement that people must be over the age of 13 to use their service, are about as effective as actual lines in the sand. As such, companies need to bear more responsibility for who they’re collecting data on and who they’re targeting their ads at.

If a kid that’s eleven tells YouTube they’re 33 and YouTube collects their data, that’s one thing. But one of the chief complaints against YouTube is that they’ve specifically targeted kids under the age of 13 with data collection and advertising. That would mean they were aware of the child’s actual age and used that to their advantage. If that’s true, YouTube could face some serious legal ramifications.
